Privacy Policy

Thank you for your interest in MobileServe!  The issue of data protection and privacy is one we take seriously.  We have compiled this privacy policy to inform you about the types of data we may collect and how we use that data.  We firmly believe that information about you that can be used, on its own or with other information, to identify, contact, or locate you (“Personal Information”) and information about your behavior with respect to the Services is your information, and we will always treat it as such.  We will not sell your Personal Information, and we will not do anything else with your Personal Information that is not directly related to our provision of the Services.  Parents of INDIVIDUALS UNDER THE AGE OF 13 (“young children”) should refer to Section 7 of this Privacy Policy for SPECIFIC Information ABOUT HOW WE HANDLE THEIR YOUNG CHILDREN’S DATA.  

Together with our Terms of Service and other terms referenced and incorporated there, this privacy policy forms part of the legally binding agreement between you and MobileServe LLC (“Company,” “we,” “us” or “our”) governing your access to and use of any or all of: our website, technology platform, mobile application, and any related products and services we may offer from time to time (each, including without limitation the user experience and all general and tailored content, a “Service,” and collectively, the “Services”).  We may update this privacy policy from time to time and, when we do, we will update the date at the top of this page.  If you use any Services after such an update has been posted, you thereby agree to the changes and accept the privacy policy as so modified.


Special Notices

Individuals under the age of 13 may not use our website or any other Services, and may not create or use a MobileServe Account, without the verifiable consent of a parent.  Young children are protected by the Children’s Online Privacy Protection Act of 1998 and associated regulations (“COPPA”), which gives parents control over the personal information of their young children.  Section 7 of this Privacy Policy deals specifically with the data of young children.

If you are a resident of a European Union (EU) member state, you may not use our website or any other Services and may not create or use a MobileServe Account.  We do not knowingly collect, store or transfer information from or about any person protected by the EU’s General Data Protection Regulation or other privacy and data security laws and are not certified to handle, transfer or protect such information.  If you believe we have received such data, please contact us at the address below.

If you are a Canadian resident, you may have certain rights under the Personal Information Protection and Electronic Documents Act and other Canadian law with respect to our transfer of and your access to, correction, amendment or deletion of, or limitation on use of your personal data and our use of certain online tracking programs.  To exercise any of these rights or pose a question or request, contact us at the address below.


1. Why do we collect information from you?

First, and most importantly, we do not collect information from you in order to benefit the Company at the expense of your privacy.  Our Services are designed to help organizations and their personnel (collectively, “Sponsors”) easily manage service events and participants, to help event participants (“Volunteers”) easily track and report their service time, and to build a culture of service.  In order for Sponsors and Volunteers (each, a “User” and collectively, the “Users”) to manage and track their service projects and time, we need to collect, compile and maintain information about who these Users are and how they interact with the Services, as well as information provided by the Users about their behavior as it relates to service projects.  In short, we collect Personal Information from our Users for use by our Users and for our use in providing and improving the Services and each User’s experience in the Services.

 

2. When do we collect information and what types of information do we collect?

We collect information from or about you when you register for a User account (a “MobileServe Account”) or one is created for you by an organization or Sponsor to whom you have provided your information, and at other times when you (or, if applicable, your organization or Sponsor) fill out a form or enter information on our Services.  At these times, you (or, if applicable, your organization or Sponsor) may be asked to enter your name, email address, home or mailing address, zip code, phone number or other details that will enable you (and, if applicable, your organization or Sponsor) to make use of the Services and to enable us to provide the Services to you and personalize your experience.  We may, from time to time, ask you for contact information for other people (such as parents of Users under the age of 18).  We will only use that information for the reason specified in our request.  In any such circumstance, please ensure that you have permission to share that information before providing it for us.

In some situations, we may also ask for your age and geographical location, to help us comply with laws that apply specifically to people in certain age groups or geographical areas (see the Special Notices above), and may automatically collect your location to enable reporting of volunteer time and locations through the Services.

We also collect some technical information automatically in the course of your use of the Services.  For example, we gather general statistical information about our Services and Users, such as IP addresses, browsers, pages viewed, number of visitors, goods and services purchased, etc., but in doing so we do not reference you by individual name, email address, home address, or telephone number.  We may also automatically collect technical data about your mobile device and network, such as a unique device identifier, device operating system and browser, and telephone number.  We use this data in the aggregate to analyze how are Services are used so we can improve the Services.  We may also use trusted third party services that track this information and analyze it on our behalf.  We may provide this statistical information to third parties, but when we do so we do not provide Personal Information without your permission.

We sometimes combine the technical data we collect with other information we know about you, to enhance and improve the Services and your user experience.

As part of our Services, we use “cookies” to store and sometimes track information about you.  Cookies are small files that a website or service provider send to your browser for storage on your hard drive (if you allow) that enables the site’s or provider’s systems to recognize your browser and capture and remember certain information.  Generally, cookies help us remember and understand your preferences based on previous or current site activity, in order to provide you with an improved experience with the Services.  In some instances, third party advertisers or vendors appearing at our Marketing Website (MobileServe.com) may use their own cookies.

 

3. Can you stop or limit our collection of your information?

Yes—but, as explained above, due to the nature and technological requirements of the Services (particularly when delivered via mobile app), our Services cannot function without collecting certain information about you.  If you do not wish to have your use of the Services tracked at all, do not use the Services.  You may cease using the Services at any time.

If you wish to change or delete personal information in your MobileServe Account, you may log into the account and do so.  If you have trouble changing or deleting personal information in this manner, you may contact us and we will attempt to assist you.  Note, however, that we may require you to verify your identity before we give you any information or make any changes you request, and we may not be able to delete certain information unless you cease using the Services.

You can choose, through your browser, to allow or block cookies universally or on a one-time basis.  If you disable cookies, some features of our Services may cease to function properly or at all.

 

4. How do we use your information?

We may use the information we collect from and about you to personalize your user experience and allow us to deliver the type of content and product offerings in which you are most interested, to connect you with service organizations you volunteer with, or to send periodic communications regarding the Services, your orders or other products and services.  In accordance with the CAN-SPAM Act (which establishes rules for commercial email), you can email us and have us promptly remove you from all correspondence.

We may, from time to time, share information we have collected from and about you with law enforcement, other governmental agents, or other persons as required by law.  We also reserve the right to share your information with third parties as necessary, in our sole discretion, to protect the rights, property or safety of us, our Users, or any child, to preserve the security of our Services, and to prevent or address a threat of harm, violation of law, commission of fraud, of breach of any agreement to which we are a party.

To facilitate our Users’ use of the Services, Sponsors are able to see information provided by Volunteers who volunteer with them, including but not necessarily limited to a Volunteer’s name, photograph(s), email address, student or employee number, service locations and service hours.  Note that we are not, and do not represent, any Volunteer or any Sponsor or other service organization and cannot control how such Users handle information you give to them, either through our Services or otherwise.  You should always exercise caution when sharing your Personal Information with others and decline to provide information to any person or organization which you do not trust.

We also store your information, and may back up or archive copies of your information, in order to provide the Services to you and to comply with applicable laws and regulations.

 

5. How do we secure your information?

Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential.  To maintain the safety of your personal information, we implement a variety of security measures when a User enters, submits, or accesses their information.  All sensitive/credit information you supply is encrypted via Secure Socket Layer (SSL) technology.  Our website is scanned on a regular basis for security holes and known vulnerabilities in order to make your visit to our site as safe as possible.  We use regular Malware Scanning.

 

6. Do you interact with any third parties by visiting our website or using our Services?

We do not include or offer third party products or services on our website, but we do partner with certain third parties.  All financial transactions are processed through a gateway provider and are not stored or processed on our servers.  We utilize third party software to help us track how users are interacting with our site, as well as to advertise our product offering to those who visit our marketing website (MobileServe.com).

 

7. How do we handle Personal Information about individuals under the age of 13 (“young children”)? What rights do you have as a parent or legal guardian of a young child who uses or wishes to use the Services?

The information in this section applies only to children under the age of 13.  Where information in this section conflicts with information elsewhere in the Privacy Policy: (i) the information in this section will apply to young children, and (ii) the conflicting information elsewhere in the Privacy Policy will apply to everyone else.

Some of our Users are schools and other groups that encourage children, including some under the age of 13, to perform volunteer work.  We think giving kids opportunities to serve others is a great idea, and we are thrilled when Sponsors elect to use our Services to help teach volunteerism to the next generation.  We also think it’s important to do our part to help protect children’s privacy.  We do not sell young children’s personal information, and will not share or transfer that information except as explained in this Section.

Your Parental Rights

When it comes to your young child’s information, you are in charge.  In order for your young child to sign up for and use our Services, we must first receive your verified consent for them to do so.  You will set or obtain your young child’s account password at sign-up and whenever it is changed so you are able, at any time, to review your young child’s personal information by logging into their account and to modify their personal information as described in Section 3.  You may also, at any time, decide to withdraw your consent for your young child to access and use the Services and refuse to permit further collection or use of your young child’s Personal Information.  If you believe we have received personal information about a young child without parental consent, please contact us so we can take appropriate steps to investigate and remove it (although we may not be able to remove it from our backup systems).

Types of Information We Collect from Your Young Child

We will never collect more information from a young child than is reasonably necessary for us to provide and enable their use of the Services.

In order for your young child to sign up for the Services, we will obtain your verifiable consent and then allow the young child to register for a MobileServe Account.  The information we may collect during the registration process includes the child’s age, first and last name, email address, school, school or home address (including zip code), phone number, and a username and profile picture.  We will specify which information is required and which information is optional at the time it is collected.

As your young child uses the Services, we may automatically collect information about their use of the Services in the same manner and to the same extent as we do adult Users.  Section 2 of this Privacy Policy describes the types of data that are automatically collected from all Users.  Section 3 describes how, and to what extent, you may opt your young child out of certain information collection performed by us.

As described in Section 6, certain third-party operators may collect or maintain information from all Users of our Services, including young children.  A complete list of these operators, along with their contact information for questions about their privacy policies or handling of young children’s information, is located here ([link]).

How We Use Your Young Child’s Information

We may use the personal information we collect from your young child (either upon request during the registration process or when provided to us through the MobileServe Account): for registration in our records and creation/maintenance of a MobileServe Account; to provide the Services to the young child and enable the young child to use the Services to track and report their service to their school or other Sponsor; and to communicate with the young child about service projects and the Services.

Your young child is able, through the Services, to connect with other Users—both Sponsors (such as the child’s school) and other Volunteers.  Any User who is connected with your young child through the Services will be able to see Personal Information in the child’s profile.  The Services do not provide a means for Volunteers to communicate with one another, but Sponsors with which your young child has connected have the ability to, and may from time to time, communicate with the child through the Services.  We do not represent your child’s school or any other User and we do not control any third party’s actions on the Services or monitor Sponsors’ communications with their Volunteers.  To protect young children in their use of the Services, and of the internet more generally, we encourage all parents to regularly monitor their online activity and to teach them how to be safe online.
